$5 Million for Nail Polish!

On or about early January 2010, American Apparel began receiving reports from its customers and retail employees that the nail polish manufactured by Forsythe Cosmetics was “exploding.” Specifically, reports began surfacing that the bottles contaning the nail polish were breaking, leaking, cracking, etc.

Just like wet nail polish, American Apparel’s reputation began to stink! Headlines from reputable fashion and style blogs across the web began to question AA’s products. In the complaint listed below, you will see that American Apparel sued for Strict Products Liability, Breach of Warranties, Negligence, and Breach of Contract.

But 5 MILLION DOLLARS for manicure products? The reality is American Apparel cannot afford the bad publicity. They only launched their Nail Polish line in 2009 so the defective nail polish  is a like detonating a ticking time bomb for the future of its cosmetics line. Subsequently, the $5,000,000 in damages they are suing for is going to be used to help restore their image. However, according the Stylelist, Forsythe believes that the lawsuit is “a suspense-novel-worthy chain of melodramatic alleged events.” Most likely they will settle for an amount that will help American Apparel research and develop lewd nail polish advertisements.
